Terms of Service

Agreement and operator

These terms govern your use of the service operated by Springtide Labs, LLC. Questions, reports and account requests go to support@image26.io. By using the service, you agree to these terms and the Acceptable Use Policy. If you do not agree, do not use the service. You must have the legal capacity and meet the applicable minimum age to enter this agreement; anyone acting for an organization must have authority to bind it.

Accounts and service

Provide accurate account and billing information, protect your credentials and tell us promptly about suspected unauthorized use. Do not share access to bypass limits, compromise another account or interfere with the service. Contact us by email to request account closure; closure and subscription cancellation are separate requests.

The service provides the image generation and editing features currently offered. Availability depends on the selected model, provider and safety checks. Model labels and available choices appear on the relevant generation pages; a listed model does not imply endorsement by its developer. Outputs can be inaccurate, unsuitable or similar to other users' outputs. Review them before use and do not present fabricated content as authentic evidence or rely on it as professional advice.

Inputs, outputs and rights

Submit only material you own or are authorized to use and share with generation and safety services. For identifiable people, you must have the necessary consent and rights to use their images and personal information. Consent does not permit face swaps, nudification, fabricated real-person identities or actions, or fabricated intimate scenes; these remain prohibited under the Acceptable Use Policy.

You retain your rights in inputs. You authorize the processing, copying, storage and transmission needed to provide the requested service, perform safety checks and handle support or disputes. Any rights you may have in outputs remain subject to applicable law, provider terms and others' rights. We do not guarantee that an output qualifies for copyright, is exclusive, is cleared of third-party rights or is suitable for commercial use. You must assess your intended use. Rights in the service's software, branding and other original materials remain with their respective owners.

Offers, prices and credits

Review Pricing, the selected offer and checkout before buying. The offer identifies the price, currency, billing interval, included features, credit quantity, grant timing and validity. Applicable taxes and the final total are shown by the transaction seller at checkout or on its receipt; do not assume all displayed prices include tax. Keep your purchase confirmation.

Credits are service usage units, not a bank balance or cash equivalent. Their grant, consumption and expiry follow the selected offer and the associated credit records. A monthly or annual label does not by itself promise monthly credit grants, rollover, free credits or credits without expiry. Cancellation does not automatically extend or reset existing credit validity. Model and tool usage costs follow the applicable service offer and displayed usage terms.

Seller, payment handling and recurring authorization

The product operator remains responsible for the software and technical support. The seller identified at checkout and on the receipt is responsible for its transaction duties, including receipts, applicable tax handling and payment-related consumer obligations under its terms and applicable law.

• Stripe Managed Payments / Link: only when checkout uses Managed Payments, the Stripe/Link entity identified there acts as merchant of record and handles the sale under the checkout terms.
• Ordinary Stripe: Stripe processes payments; using Stripe or Link as a payment method alone does not mean Stripe is the merchant of record. The seller is the entity identified for that purchase.
• Waffo Pancake: for a Waffo checkout, the identified Waffo seller handles the sale and payments in its merchant-of-record role under the terms shown for that transaction. Availability and eligibility depend on that checkout.

By confirming a recurring offer, you authorize the seller/payment provider to charge the chosen payment method at the stated interval and price, with applicable taxes, until cancellation takes effect. Review any trial, renewal or price-change terms shown for that offer. Required notice and consent for changes remain subject to applicable law. A one-time purchase does not itself authorize recurring charges.

Cancellation and refunds

Manage an available subscription in Billing or through the seller's instructions on your receipt; email us if you need help. Check the provider's confirmation for the effective date and resulting access. Cancellation may take effect immediately, including for Stripe subscriptions cancelled here. Continued access to the end of a billing period and later resumption are not guaranteed. Cancellation alone does not issue a cash refund.

Under our Refund Policy, you may request a full cash refund within seven days of a purchase when all credits from that purchase are completely unused, including an annual purchase. We review the actual purchase and use and process eligible requests through the original seller/payment channel. Credit returns for tasks are distinct from cash refunds. This does not promise annual proration or restrict mandatory consumer rights or applicable seller protections.

Safety, restrictions and disputes

Image flows use OpenAI to review prompts, reference images and generated images. A request or result may be blocked or unavailable when review rejects it, remains unresolved, or cannot be completed. These automated services can make mistakes and do not guarantee that every violation is detected. Operators handle reports and appeals through the contact above as described in the Acceptable Use Policy.

Violations may lead to content removal, feature restrictions, suspension or an account ban. Fraudulently obtained or improperly claimed promotional credits may be revoked after review. A report alone does not automatically forfeit legitimate purchased balances; applicable purchased entitlements and mandatory rights must be respected. You may appeal by email with the decision or task reference and reasons for reconsideration.

Availability, responsibility and changes

We aim to provide the offered service, but do not guarantee uninterrupted access, error-free output or a particular creative result. We may change or discontinue features or take necessary safety action, subject to existing purchase obligations and applicable law. To the extent allowed by law, we exclude liability for indirect or consequential loss from use of the service. This does not exclude liability or remedies that cannot lawfully be excluded, including mandatory consumer protections.

The Privacy Policy describes data handling. Revised terms carry an updated date. Material changes require any notice and renewed agreement required by applicable law; publication alone does not retroactively change completed purchases or supply consent for a new purpose. Contact us to seek resolution of a dispute; this does not restrict access to statutory remedies or the competent courts.
